Our Privacy and Terms and Conditions

Last Updated: July 31, 2025

Introduction

Welcome to eSIM Pro (esimpro.com). This page outlines our Privacy Policy, Terms & Conditions, and Cookie Policy. By using our website, you agree to the following terms and practices. We are committed to complying with international data protection laws – including the EU General Data Protection Regulation (GDPR), Singapore’s Personal Data Protection Act (PDPA), and Japan’s Act on the Protection of Personal Information (APPI) – as well as Japanese e-commerce regulations. Please read these terms carefully. If you do not agree, please discontinue use of our site.

Privacy Policy

Information We Collect

  • Personal Information: When you place an order, we collect information such as your name, email address, and billing details (billing address and payment confirmation). This information is necessary to process your purchase.
  • Payment Information: Payment details (e.g. credit card or PayPal information) are collected and processed securely by our third-party payment processors (Stripe, PayPal, WooPayments). We do not store your full payment card numbers on our servers.
  • Usage Data: We collect basic website usage data through cookies and similar technologies. This includes data like items added to your cart and session information to keep your shopping cart active. We may also collect technical data such as your IP address and browser type for security and analytics. (See Cookies & Tracking below for more details.)

How We Use Your Information

We only use your personal data for specified, legitimate purposes:

  • To Process and Deliver Orders: We use your name and billing information to process payments and deliver your eSIM QR code. This is necessary to fulfill the contract of your purchase.
  • Customer Support: If you contact us (e.g. via email or support ticket), we will use your email address and order information to assist you and resolve any issues.
  • Website Improvement: We analyze usage data (e.g. how users navigate our site) to debug issues and improve our website’s functionality and user experience. This helps us ensure a smooth shopping experience. (Where required by law, we will obtain consent for any analytics cookies not strictly necessary.)
  • Legal Compliance: We may use and retain data as needed to comply with legal obligations – for example, keeping transaction records for tax and accounting purposes or cooperating with lawful requests from authorities.

We do not use your data for marketing or advertising purposes. In particular, we do not send any newsletter or marketing emails, and we do not sell or rent your personal information to third parties.

Legal Basis for Processing

Our legal bases for processing personal data are as follows:

  • Contractual Necessity: We process personal information to fulfill our contract with you – i.e. to provide the eSIM service you requested and paid for. For example, using your data to complete payment and deliver your eSIM is necessary for the performance of the purchase contract (under GDPR Article 6(1)(b), and equivalent principles under PDPA and APPI). If you choose not to provide required personal data, we cannot fulfill your order.
  • Consent: We rely on your consent for any optional or non-essential data processing. In particular, we will request consent for the use of non-essential cookies or similar technologies in accordance with GDPR/ePrivacy rules. You have full control over such cookies via our consent banner. (Note: Essential cookies that are needed for site functionality – e.g. to remember your cart – are used based on implied consent/strict necessity.)
  • Legal Obligation: When we are subject to legal obligations that require processing of personal data (for instance, retaining transaction records for tax law compliance or responding to government requests), we process data on that basis (GDPR Article 6(1)(c)).
  • Legitimate Interests: At this time, we do not process your personal data based on “legitimate interests” except where indicated (such as our minimal use of usage data to improve our services, which we ensure does not override your rights). If we ever rely on legitimate interests, we will only do so after considering your privacy rights and, if required, providing an opt-out.

Data Sharing and Disclosure

We treat your personal information with care and confidentiality. We only share data with third parties in a few scenarios, and always under necessary safeguards:

  • Service Providers: We share required information with trusted partners who help us run our business. This includes payment processors (like Stripe, PayPal, WooPayments) to handle your transactions, and our eSIM telecommunications service provider (which provides the actual eSIM connectivity service). These partners only receive the data necessary to perform their specific services (for example, payment processors receive your card information, eSIM provider receives the data needed to activate your mobile service). All such partners are contractually obligated to protect your data and to comply with applicable data protection laws.
  • Legal Requirements: If we are under a duty to disclose or share data to comply with a legal obligation or government request, we may do so. For example, we might disclose information in response to lawful requests by public authorities or to meet national security or law enforcement requirements.
  • Business Transfers: In the unlikely event that our company is involved in a merger, acquisition, or sale of assets, personal data may be transferred to the new owner to the extent permitted by law and subject to confidentiality agreements. (If such a change occurs, we will notify you and ensure your rights continue to be protected.)

We do not share your personal data with any third parties for marketing or advertising purposes. We also do not allow third-party analytics or advertising companies to collect personal data from our site without your consent.

Data Security

We take the security of your personal data seriously. We implement industry-standard security measures to protect your information from unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Encryption: Our website uses HTTPS/TLS encryption to secure data transmitted between your device and our site. Sensitive information (like payment details) is handled via secure, PCI-DSS-compliant payment gateways.
  • Access Controls: Personal data is accessible only by authorized personnel who need it to perform their duties (for example, customer support agents or IT administrators), and only on a need-to-know basis. We restrict and audit access to customer information.
  • Secure Storage: We store data on secure servers with protections against unauthorized intrusion. We regularly update and patch our systems and employ firewalls and monitoring to prevent and detect potential vulnerabilities or breaches.
  • Organizational Policies: Our team is trained on data protection best practices. We maintain internal policies to safeguard data and handle it in accordance with applicable laws.

Please note that while we strive to protect your data, no website or electronic transmission can ever be guaranteed 100% secure. However, we follow strict security protocols and will promptly notify users and authorities as required in the event of any data breach.

Data Retention

We retain personal data only for as long as necessary to fulfill the purposes outlined in this policy, or as required by law, whichever is longer. After that period, we will securely delete or anonymize the data. Our retention periods for different categories of data are:

  • Order and Payment Records: We keep records of your purchases, including invoices and payment confirmations, for 7 years. This retention is to comply with accounting and tax regulations, and for our internal record-keeping.
  • Customer Support Correspondence: If you contact us for support, we retain that correspondence (emails or support tickets) for up to 1 year after your issue is resolved. This helps us improve our services and refer back to previous communications if you have further questions.
  • Usage Data: Analytics and usage data (collected via cookies or our server logs) are retained for a maximum of 6 months. We use this aggregated data to improve the website and then either delete or anonymize it. Cookie data may be cleared sooner if you withdraw consent or clear your browser cookies.
  • Legal Holds: In the event of a dispute, investigation, or legal requirement, we may retain relevant data beyond the standard retention period until the issue is resolved.

After the applicable retention period, personal data that is no longer needed is deleted from our active systems. Backups are also purged in the normal backup rotation cycle. If deletion is not immediately feasible (for example, stored in secure archives), we will isolate the data and protect it from further use until deletion is possible.

Your Rights

We respect your rights over your personal data. Depending on the laws that apply to you (GDPR, PDPA, APPI, etc.), you have the following rights regarding your personal information:

  • Right to Access: You may request a copy of the personal data we hold about you, as well as information on how we process it.
  • Right to Correction: If any of your information is incorrect or outdated, you have the right to ask us to correct or update it.
  • Right to Deletion: You can request that we delete your personal data. For example, if you no longer plan to use our services, you may ask us to erase your information. We will honor such requests to the extent possible – keeping in mind certain data may be retained as required by law (e.g. purchase records for tax purposes) or legitimate business needs.
  • Right to Restrict Processing: You have the right to ask us to restrict (pause) the processing of your data in certain circumstances – for instance, if you contest the accuracy of the data or object to our processing, we will restrict use while we address your concern.
  • Right to Data Portability: You may request a copy of the personal data you provided to us in a structured, common electronic format, so you can reuse it or transfer it to another service. For example, we can provide details of your orders in a CSV file upon request.
  • Right to Object: You have the right to object to certain processing activities. For example, you can object to any direct marketing (though we currently do not perform marketing), or object to processing based on legitimate interests. If such a scenario arises, we will stop processing your data for that purpose unless we have a compelling legitimate ground to continue or it is needed for legal claims.
Right to Withdraw Consent: If we are processing any of your data based on your consent (e.g. for optional cookies), you have the right to withdraw that consent at any time. Withdrawing consent will not affect the lawfulness of processing done before the withdrawal. If you withdraw consent, we will stop the specific processing that was based on consent.
Right to Lodge a Complaint: If you believe your data protection rights have been violated, you have the right to lodge a complaint with a supervisory authority. For EU/EEA residents, this could be your local Data Protection Authority (for example, the Estonian Data Protection Inspectorate or another EU regulator). Singapore individuals can contact the Personal Data Protection Commission (PDPC). Japanese individuals can consult the Personal Information Protection Commission (PPC) in Japan. We encourage you to contact us first to resolve any issue, but you do have the option to seek help from regulators.

Exercising Your Rights: To make any request regarding your data, please email us at esimpro.support@gmail.com. Include your name and the email used for your purchase, and clearly state which right you wish to exercise (e.g. “Request for data deletion”). For security, we may need to verify your identity before fulfilling the request. There is no fee for these requests in most cases. We will respond to your inquiry as soon as possible, typically within 30 days. If we need more time or cannot comply with a specific request (for example, due to a conflicting legal obligation), we will inform you and explain the reason.

Cookies & Tracking Technologies

Our website uses cookies and similar technologies to ensure basic functionality and to improve your experience. A cookie is a small text file placed on your device when you visit a website. We use the following types of cookies on our site:

Essential Cookies: These are first-party cookies that are strictly necessary for our site to operate. For instance, when you add an item to your cart, an essential cookie remembers your cart contents as you navigate the site. Similarly, when you proceed to checkout, cookies help keep your session active. These cookies do not store personal details beyond what’s needed for functionality, and they expire after a short period (or when you close your browser). Because they are necessary for the service, they are used by default.
Preference/Functional Cookies: If our site has any user preferences (such as remembering your language or region selection), cookies may be used to store those preferences. (Note: Currently our site is English-only and for one region, so this is minimal.)
Analytics Cookies: We may use analytics tools to understand how users interact with our site (for example, which pages are visited, how long is spent on each page, etc.). These tools might set their own cookies. We only use analytics cookies if you give consent via the cookie banner. All such cookies are opt-in. The information from analytics cookies is used in aggregate form to improve site performance and design.
Advertising/Marketing Cookies: None. We do not use any third-party advertising cookies or trackers on our site at this time. We do not serve targeted ads, so you will not find ad cookies (like Google Ads or Facebook pixels) on esimpro.com.

Cookie Consent: When you first visit our website, you will see a cookie consent banner. This banner allows you to accept all cookies or choose specific cookie preferences (for example, you can enable or disable analytics cookies). We use a compliance plugin (such as CookieYes or Humanity.co’s Cookie Notice) to manage your consent in line with GDPR and CCPA requirements. Non-essential cookies (like analytics) will only be set if you explicitly allow them. You can change or withdraw your consent at any time by clicking the “Cookie Settings” link on our site or by clearing cookies in your browser.

Managing Cookies: Most web browsers let you control cookies through their settings. You can refuse or delete cookies. However, please note that if you block essential cookies, certain features of our site (like the shopping cart or checkout) may not work properly. For guidance on how to adjust cookie settings, check your browser’s help documentation.

For more details, please see (expand) our Cookie Policy which provides a breakdown of all cookies in use.

B) Essential (Strictly Necessary) – third-party during checkout:
When you pay via Stripe/PayPal/WooPayments, you may see cookies on their domains to prevent fraud, maintain session security, and complete authentication. These run only on their checkout pages/iframes.

C) Preferences/Analytics/Marketing:
Currently not used. If we enable analytics in the future, they will be off by default and appear here with names, purposes, and durations. You will be able to opt in/out any time.

International Data Transfers

eSIM Pro is an international service. By using our site or purchasing an eSIM, your personal data may be transferred to and processed in countries other than your own. In particular:

Our company is based in the European Union (Estonia), so your data will be stored on servers within the EU.
We utilize service providers outside the EU. Notably, our eSIM fulfillment partner is based in Singapore, which means certain order data (such as the information needed to activate your eSIM) will be transmitted to Singapore.
We may also use other third-party services or cloud platforms that are located in other countries (for example, email service or cloud hosting providers). We ensure any such providers have strong data protection measures.

When we transfer personal data internationally, we take steps to safeguard your privacy in line with applicable laws. If you are located in the European Economic Area (EEA) or UK, any transfer of your personal data outside the EEA/UK will be protected by Standard Contractual Clauses (SCCs) or an equivalent legal mechanism. SCCs are contractual commitments approved by the European Commission that bind the overseas recipient to protect your data according to GDPR standards. In the case of transfers to our partner in Singapore, we have put agreements in place to ensure your data receives a level of protection comparable to EU/EEA law and Singapore’s PDPA requirements.

Japan’s APPI also imposes restrictions on transferring personal data overseas – such transfers are allowed only if the recipient country has adequate data protection laws, or appropriate safeguards (such as contractual clauses) are in place, or the individual consents. We adhere to these requirements by using contractual safeguards and obtaining consent via this privacy policy disclosure.

Regardless of destination, we will protect your information consistent with the originating jurisdiction’s laws. We continuously monitor developments in privacy regulations to ensure our cross-border data practices remain compliant. If you have questions about international data transfers or want more details about our safeguards (for example, a copy of the relevant contractual clauses), you can contact us at any time.

No Automated Decision-Making

We do not use your personal information for any automated decision-making or profiling that produces legal effects or similarly significant effects on you. In other words, there are no algorithms making important decisions about you without human involvement. All decisions regarding our service provision (such as fraud screening or customer support responses) involve manual review by our staff. If this policy changes in the future, we will update you and ensure compliance with applicable laws (including obtaining your consent if required for such automated processing).

Updates to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or relevant laws. When we make changes, we will post the updated policy on this page and update the “Last Updated” date at the top. For any significant or material changes, we will additionally provide a prominent notice, such as an email notification to our customers or a banner on our website. We encourage you to review this page periodically to stay informed about how we are protecting your information.
If you continue to use the website or our services after an update takes effect, it means you accept the revised policy. If you do not agree with any changes, you should stop using our site and can contact us to have your data removed if applicable.

Terms & Conditions

Acceptance of Terms

By accessing or using the esimpro.com website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. These terms apply to all transactions and interactions on our site. If you do not agree with any part of the terms, please do not use our website or purchase our products. (If you are making a purchase on behalf of another person or an entity, you represent that you have the authority to accept these terms on their behalf.)

Our Services

eSIM Pro provides digital eSIM plans that offer fast, reliable mobile data internet service in Japan. Our eSIMs are designed for short-term visitors (such as tourists) in Japan who need mobile data connectivity without buying a physical SIM card. When you purchase an eSIM plan from us, you will receive an electronic SIM (in the form of a QR code) that you can install on your compatible device to access cellular data networks in Japan. The specifics of each plan (data allowance, validity period, price, etc.) are described on our product pages. We strive to ensure that our eSIM services are available and perform as advertised; however, actual data speeds and coverage may depend on the local network operator and your device.

Purchasing and Payments
When you place an order on our website, you agree to provide current, complete, and accurate purchase and account information. Specifically:

Eligibility: You must be at least 18 years old to make a purchase on esimpro.com. If you are under 18, you may only purchase with the involvement and consent of a parent or legal guardian. By ordering, you confirm that you meet this requirement.
Account Creation: We do not require account registration or login to make a purchase. You will provide the necessary details during checkout (such as name, email, and payment info) without creating a stored user account.
Accepted Payment Methods: We accept major credit and debit cards, and other payment methods as indicated at checkout (including PayPal). Payments are processed securely via third-party payment gateways (Stripe, PayPal, or WooPayments on WordPress). This means your payment details are handled by these providers. By providing your payment information, you authorize us (and our payment processors) to charge the total order amount.
Pricing: All prices for our eSIM plans are displayed on our website. Prices are shown in USD and include applicable taxes and fees unless otherwise statedhttps://docs.adyen.com/industries/markets/japan/scta-and-psa/. We do not add hidden surcharges beyond what is clearly shown in your cart at checkout. (In the event that you are charged in a different currency, your bank or card issuer may apply a conversion rate or fees, for which we are not responsible.)
Payment Timing: When you confirm your purchase at checkout, your payment method will be charged immediately for the full price of the eSIM plan. The transaction will typically be processed within seconds or minutes. You will receive an on-screen confirmation and an email receipt once payment is successful. If payment fails or is declined, the order will not be completed.
Order Confirmation: After payment, you should receive an order confirmation email at the address you provided. This will recap your purchase details. It is your responsibility to provide a valid email and to check that email for the confirmation and subsequent delivery of the eSIM QR code. If you do not receive a confirmation email within a few minutes, please check your spam folder or contact our support.

Delivery of eSIM

Our product is delivered digitally. Once your purchase is completed:

You will receive an email (sent to the email address provided at checkout) containing your eSIM QR code and activation instructions. This email is typically sent within 15 minutes of your purchase being successful (often within seconds). In rare cases, it could take slightly longer due to system processing or high demand, but most customers get the eSIM almost instantly.
The email will provide clear steps on how to install the eSIM on your device. Generally, you will use your smartphone’s camera or settings to scan the QR code and add the eSIM as a mobile data plan. We will also include any necessary details like an activation code or PIN if required (though usually just scanning the QR is enough).
Delivery Issues: If you do not receive the eSIM email within 15 minutes, first check your spam/junk mail folder. If it’s not there, please contact our customer support (see Contact Us section below). We can resend the email or provide the QR code through an alternative method if needed. Ensure that you provided the correct email address; a typo in the email is a common cause of non-delivery.
The eSIM is considered delivered once we have sent the QR code to your email. At that point, you have access to the product. Please note that the eSIM can only be installed once on a single device. Treat the QR code like a one-time ticket – do not share it, because it will become bound to the first device that installs it.

We make no physical shipments. There are no shipping fees or physical delivery times to worry about. The service is entirely digital for your convenience. If you encounter any issues during eSIM installation (for example, error messages or compatibility problems), contact us and we will assist you to get it resolved as quickly as possible.

Refund Policy

Because our products are digital and provide telecommunications access, our refund policy is necessarily limited. All sales are final once an eSIM has been delivered and/or activated. Activated eSIMs are generally non-refundable due to their digital nature (once issued, they cannot be returned or resold). However, we do want you to have a working service. If you are unable to use your eSIM due to a technical issue or it does not function as advertised, we will work with you to find a solution. Our policy is as follows:

No “Cooling-Off” Period: Please note that there is no automatic cooling-off cancellation period for online digital sales of this nature (under Japanese law, mail-order transactions are not subject to cooling-off rules). Once you purchase and we deliver the eSIM, you do not have an automatic right to cancel for a refund simply because you changed your mind.
Activation Issues or Non-Use: If you are unable to activate your eSIM or it never worked from the start (for example, you scan the QR code and it fails to provide connectivity), you should contact us as soon as possible. We may request evidence of the issue (such as error screenshots or information about your device). If we determine that the problem is on our side (e.g., a faulty QR code or carrier issue) and cannot quickly fix it, we will offer you either a working replacement eSIM or a full refund of your purchase price.
Service Not As Described: If the eSIM service materially does not match what was promised (for instance, you purchased a 5 GB data plan but the network provided significantly less data or no network coverage in the advertised area), please let us know. We may provide a remedy such as an extension of service, a partial refund, or a replacement eSIM, depending on the situation. Our goal is to ensure you get the service you paid for.
How to Request a Refund/Support: For any issues, you must email esimpro.support@gmail.com within 14 days of your purchase to report the problem. Include your order details (order number or email used, and date of purchase) and a description of the issue. We may follow up with troubleshooting steps. If the issue cannot be resolved, and it falls within our policy (eSIM not activated or not as described), we will process a refund or send a replacement eSIM code. Refunds (if approved) will be credited back to your original payment method. Please allow 7–14 business days for us to investigate your claim and issue the refund or replacement.
Non-Qualifying Cases: We generally do not provide refunds in cases of user error or if the eSIM works as intended. For example, if you purchased an eSIM and it was delivered promptly and functions, we will not refund simply because you no longer want it or bought it by mistake. Similarly, if your device is not eSIM compatible or you did not follow the instructions, those are not faults of the product (though we will try to assist you in getting it working). Please review the device compatibility and plan details before purchase.

This refund policy does not affect any statutory rights you may have under consumer protection laws that apply to you. We stand by the quality of our service and will make a good-faith effort to ensure you are satisfied within the boundaries of this policy.

Intellectual Property

All content and materials on the esimpro.com website – including text, images, graphics, logos, design, software, and other elements – are the intellectual property of eSIM Pro (or our content suppliers) and are protected by copyright, trademark, and other intellectual property laws. You are authorized to access and use the website and its content for your personal, non-commercial use (for example, to read information, make a purchase, and use your eSIM service). Any other use is prohibited without our prior written permission. This means you may not:
Reproduce, copy, or redistribute website content for commercial purposes.
Modify or create derivative works based on our content.
Use any trademarks, logos, or branding belonging to eSIM Pro except as allowed by us.
Use automated systems (like bots or scrapers) to collect content or information from our site without permission.

The “eSIM Pro” name and logo are trademarks/service marks of our business. All rights not expressly granted in these terms are reserved. If you violate the intellectual property rights, we may terminate your use of the site and take legal action if necessary. If you believe any content on our site infringes your own intellectual property rights, please contact us with details, and we will investigate and address the concern.

Limitation of Liability

We strive to provide an excellent service, but there are limits to our liability as permitted by law. To the fullest extent allowed by applicable law, eSIM Pro (and its owners, employees, and affiliates) shall not be liable for:

Any indirect, incidental, special, or consequential damages that result from the use of (or inability to use) our website or eSIM services. This includes, for example, damages for loss of data, loss of connectivity, inconvenience, or lost profits arising from the use of the eSIM service or site.
Any direct damages in excess of the price you paid for the product giving rise to the claim. Our maximum liability to you for any claim related to a purchase is the amount you paid for that eSIM plan.
Any delay or failure in performance resulting from causes beyond our reasonable control, such as telecom network outages, internet disruptions, natural disasters, or acts of government.

Exceptions: Nothing in these terms excludes or limits liability that cannot be excluded by law. For instance, if applicable law in a jurisdiction does not allow exclusion of certain warranties or limitation of certain damages, those laws will prevail to the extent they apply. Additionally, we do not seek to exclude liability for gross negligence, intentional misconduct, or personal injury caused by our negligence. Your statutory rights as a consumer are not affected.

Keep in mind that the eSIM service relies in part on third-party networks (the mobile carriers in Japan). We are not responsible for outages or performance issues on those networks, but we will help liaise with the provider if problems arise. We provide the eSIM service “as is” and do not guarantee that it will be available 100% of the time or meet any specific performance metrics, though we certainly aim for a high-quality experience.

Governing Law and Dispute Resolution

These Terms & Conditions and any transactions for eSIM purchases are governed by the laws of Japan, without regard to its conflict of law principles. We choose Japanese law given that the service is used in Japan and to ensure compliance with Japanese regulations. By using our service, you agree that any disputes or claims arising out of or in connection with these terms or your use of the site will be addressed under Japanese law.

Jurisdiction: In the event of a dispute, we hope to resolve it amicably through our customer service. However, if a legal claim arises, you agree that the courts of Japan shall have jurisdiction to settle the matter. (Specifically, unless otherwise required by law, disputes will be resolved in the competent courts of [Japan – e.g., Tokyo District Court]). We reserve the right to seek injunctive or equitable relief in any jurisdiction if necessary to protect our intellectual property or enforce these terms.

Please note that if you are a consumer located outside Japan, you may also have certain rights or remedies under the consumer protection laws of your country of residence. These terms do not limit any consumer rights that cannot be waived by agreement. However, to the extent permitted, any claims will be handled in accordance with the governing law stated above.

Changes to Terms

We may modify or update these Terms & Conditions from time to time. Reasons for updates can include changes in our service, changes in law, or improvements/clarifications to these terms. When we update the terms, we will post the revised version on this page with a new “Last Updated” date. For significant changes, we will also provide notice either by email (to customers with recent orders) or by a prominent notice on our website. It is your responsibility to review the Terms & Conditions periodically. By continuing to use our site or services after changes to the terms are posted, you accept those changes. If you do not agree to a revised term, you should discontinue use of our services.
